EUROESPES S.A. (hereinafter, "EUROESPES" or the "Seller") provides you with an online shopping service that will allow you to purchase the articles available in our online shop (http://euroespes.com/).
In this sense, the use of this Website constitutes, insofar as applicable, your acceptance of these general conditions of sale. However, if you have any questions about them, you can contact our Customer Service.


These general conditions have been drawn up in accordance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce and Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws.

ARTICLE 2. PURPOSE
The purpose of these GCS is, on the one hand, to inform potential buyers of the conditions and procedures under which EUROESPES proceeds with the sale and delivery of the products ordered and, on the other hand, to define the rights and obligations of the parties within the framework of the sale of products by EUROESPES to the customer (hereinafter the "Buyer"). These GCS shall apply, without restriction or reservation, to all sales of products offered by EUROESPES via the Website.
Consequently, placing an order for products offered for sale on the EUROESPES Website implies full and complete acceptance by the Buyer of these GCS, knowledge of which is acknowledged by the Buyer prior to placing the order.
EUROESPES reserves the right to modify these GCS unilaterally at any time. However, the GCS applicable to the Order shall be those accepted by the Buyer at the time of placing the Order.
These GCS shall be supplemented by the general conditions of use of the Website and by the provisions of the Privacy Policy and the Cookies Policy.

ARTÍCULO 3 – FORMALIZACIÓN DEL CONTRATO Y PEDIDOS
3.1 Tarifas
El precio de venta, indicado en euros, de los productos ofertados en la Página Web de EUROESPES será el precio vigente en el momento de realización del pedido (en adelante, “Pedido”. Se entiende como Pedido aquello que se describe en el punto 3.4 de las presentes CGV). El precio de venta de los productos que aparece en la Página Web podrá en todo momento ser modificado por EUROESPES siendo el precio que aplicará a la compra el que aparece en pantalla en el momento de la realización del Pedido. Este precio será el aplicable en el marco de la venta a distancia.
El precio incluye los costes de envío, salvo modificaciones que serán indicadas en cada caso. Las diferentes modalidades de entrega y envío se establecen en el apartado 5.1 de las presentes CGV y se recordarán en la Página Web; las modalidades de envío podrán en todo momento ser modificadas por EUROESPES. Por lo tanto, EUROESPES recomienda a los compradores consultar periódicamente las CGV que figuren en la Página Web.
Los precios incluirán el Impuesto sobre el Valor Añadido (IVA), el Impuesto General Indirecto Canario (IGIC) o el Impuesto sobre la Producción, los Servicios y la Importación (IPSI) que, en su caso, pudiera corresponder y resultara aplicable en la fecha del Pedido de acuerdo con la normativa vigente. Cualquier modificación del tipo aplicable repercutirá automáticamente en el precio de los productos que EUROESPES vende en la Página Web.
3.2 Características de los productos
El Comprador podrá seleccionar uno o varios productos de entre las diferentes categorías ofertadas por EUROESPES en la Página Web.
Sin perjuicio de los Pedidos realizados por el Comprador, EUROESPES podrá en todo momento modificar el surtido de productos ofertados para su venta en la Página Web, en especial, como consecuencia de restricciones vinculadas a sus proveedores.
De conformidad con la normativa aplicable, el Comprador tendrá la posibilidad, con carácter previo al Pedido, de conocer en la Página Web de EUROESPES las características fundamentales de los productos que desee adquirir.
Los productos cumplirán los requisitos de la legislación española en vigor. EUROESPES no asumirá responsabilidad alguna en el supuesto de incumplimiento de la legislación del país distinto a España en donde hubiere de entregarse el producto (p. ej. en caso de prohibición del producto, etc.). Corresponde al Comprador verificar ante las autoridades locales del país distinto de España de entrega de los productos los límites aplicables para la importación y uso de los productos y servicios que quiera adquirir.
Para cualquier consulta relativa a los productos o para consultas complementarias o solicitudes de asesoramiento, el Comprador puede ponerse en contacto con el equipo de Asesores de EUROESPES llamando por teléfono al Servicio de Atención al Cliente al 981 780505 desde España.
3.3 Disponibilidad
Los productos mostrados en la Página Web serán válidos mientras permanezcan anunciados en la misma y, en todo caso, hasta el fin de existencias. En el caso de productos que no se encuentren en nuestros almacenes, la validez de las ofertas presentadas por EUROESPES estará sujeta a la disponibilidad de los productos. En el momento de realizar el Pedido, este ofrecerá al Comprador información que, en principio, haya sobre la disponibilidad de los productos.
En todo caso, en el supuesto de ausencia total o parcial de disponibilidad de los productos con posterioridad a la realización del Pedido, se informará por correo electrónico al Comprador, con la mayor brevedad posible, de la ausencia de disponibilidad del producto y de los retrasos en la entrega del mismo o, en su caso, de la anulación total o parcial de su Pedido.
En caso de anulación total del Pedido: El Pedido del Comprador quedará automáticamente anulado y, si no hubiera realizado el pago, no se realizará cargo alguno contra su cuenta bancaria. En caso de que ya hubiera realizado el pago, se reembolsará al Comprador el importe total del pedido con la mayor brevedad posible.
En caso de anulación parcial del Pedido: El Pedido del Comprador quedará validado por la cantidad disponible y se cargará en su cuenta bancaria el importe correspondiente del Pedido.
3.4 Pedido
La realización de un Pedido equivale a la aceptación de las presentes CGV, las estipulaciones previstas en el Aviso Legal, así como la declaración de haber leído y conocer la Política de Privacidad y la Política de Cookies, sin perjuicio de las condiciones particulares que las Partes pudieren acordar.
El Comprador tendrá posibilidad de comprobar los detalles de su Pedido y de corregir los posibles errores.
A partir del momento en que el Comprador confirme su Pedido (en adelante, el “Pedido”) se considerará que ha aceptado con conocimiento de causa el contenido y las condiciones del Pedido en cuestión y, en concreto, las presentes Condiciones Generales de Venta. Esta aceptación implica para el Comprador una obligación de pago con los precios, volúmenes, características, cantidades y plazos de entrega aceptados por el Comprador.
Una vez validada esta fase y preparado el pedido, el Comprador ya no podrá anular su Pedido. La venta tendrá carácter definitivo. El Pedido será confirmado por EUROESPES mediante el envío de un correo electrónico al Comprador (el “correo electrónico de confirmación de Pedido”).
Se remitirá al Comprador un segundo correo electrónico en el momento de la expedición de su Pedido. La aceptación de estas CGV supone la aceptación a la recepción de dicha información comercial.
EUROESPES recomienda al Comprador conservar estos dos correos electrónicos. El Comprador queda informado de que los dos citados correos electrónicos le serán remitidos a la dirección de correo electrónico que hubiera proporcionado para su identificación durante el proceso de registro, con anterioridad a la realización del Pedido.
Por otra parte, EUROESPES no asume responsabilidad alguna en caso de error en la introducción de la dirección de correo electrónico o de no recepción del correo electrónico de confirmación de Pedido. En estos casos la venta tendrá carácter definitivo, salvo en caso de anulación del Pedido por parte de EUROESPES, especialmente en el supuesto de productos sin disponibilidad. No obstante, el Comprador podrá ejercer su derecho de desistimiento en las condiciones previstas en el artículo 6 de las presentes Condiciones Generales de Venta.
Una vez cobrado el importe del Pedido, se remitirá un correo electrónico con su factura electrónica.
De conformidad con la normativa aplicable, EUROESPES se reserva el derecho de rehusar o anular por causa legítima cualquier Pedido en el que el número de productos o el importe a abonar (por un único pedido o por varios pedidos acumulados) u otros elementos manifiesten de forma que evidencie el desarrollo por parte del Comprador de una actividad económica relacionada con los productos solicitados o, con carácter general, cualquier Pedido anormal conforme a la jurisprudencia aplicable al caso.
Por último, EUROESPES se reserva el derecho a suspender o anular la ejecución y/o entrega de un Pedido, con independencia de su naturaleza y grado de ejecución, en caso de impago o de pago parcial de los importes adeudados por el Comprador, en caso de incidencias en el pago o en caso de fraude, consumado o en grado de tentativa, relacionado con la utilización de la Página Web de EUROESPES, incluyendo el fraude cometido con motivo de anteriores Pedidos.

ARTICLE 4 - PAYMENT
4.1 Means of payment - Bank cards
The means of payment through which purchases can be made on the Website are bank cards. The bank cards accepted on the EUROESPES Website are the following: Visa and MasterCard.
All bank card holders are subject to validation and authorisation checks by the card issuer. If the issuer of the purchaser's payment card refuses, or for any reason does not authorise payment in our favour, whether prior or subsequent to a payment, we shall not be liable for any delay or non-delivery.
4.2 Methods of payment
All Orders must be paid in Euros, including all mandatory taxes and duties. Any bank charges shall be borne by the Buyer (including in the event of reimbursement).
4.3 Security of payment transactions
In order to ensure the security of payments made by bank card, the Buyer shall communicate to EUROESPES the visual cryptogram (CVV) appearing on the back of the bank card used by the Buyer.
As part of the fight against fraud on the Internet, data relating to the Buyer's Order may be communicated to third parties authorised by law or designated by EUROESPES for the sole purpose of verifying the Buyer's identity and the validity of the Order, the means of payment used and the planned delivery.
Once this check has been completed, EUROESPES reserves the right to request a photocopy of the Buyer's identity document and/or any other data relating to the Buyer's identity. The Buyer has rights conferred on him by the personal data protection regulations as set out in the U-shop's Privacy Policy.
EUROESPES uses a secure payment tool called "REDSYS" with SSL certification and e-commerce code with CMS. The security of the payment relies on the authentication of the Buyer and the confidentiality of all data. To guarantee this security, the tool uses proven cryptographic techniques and complies with the requirements established in the different banking regulations applicable in Spain.

ARTICLE 5 - DELIVERY AND RECEIPT
5.1 General provisions
The Products purchased by the Buyer in accordance with the provisions of these GCS may be delivered to or collected from the address indicated by the Buyer as the delivery address for the corresponding Order.
In any event, EUROESPES informs that, as a result of current mobility restriction measures, it is not possible to guarantee scrupulous compliance with delivery times.
The Products shall be delivered by the company MRW. Delivery will be made to the address indicated by the CUSTOMER during the purchase process.
5.1.1 Shipping cost of the Order
All prices shown on the website include postage, except for modifications which will be indicated in each case.
5.2 Anomalies, damage or damaged packages
5.2.1 General provisions
The Buyer, or the recipient of the Order, is recommended to check the external condition of the package and the products at the time of delivery.
In case of anomaly related to the package (damaged package, open package, traces of liquids, etc.) or related to the product(s) ordered, the Buyer or the recipient of the Order is recommended to check the external condition of the package and the product(s) at the time of delivery.) or relating to the product(s) ordered (missing product(s), damaged product(s)), the Buyer must contact EUROESPES Customer Services to find out how to return the damaged product(s).

Notification of incidents and the formulation of complaints must be made as soon as possible and, in any case, within 5 working days of delivery of the product
5.3 Delivery times
In the event that the delivery times are exceeded for any reason other than force majeure, the Buyer may cancel his Order.
5.3.1 Product delivery times
The delivery time for the Product is a maximum of 48 hours from the confirmation of the order.
Delivery times start from the sending of the Order dispatch email.
5.3.2 Results delivery times
The results delivery time will depend on the type of Product selected.
PCR and Serological Tests: maximum 24 hours from the receipt of samples at EUROESPES.
Genetic and pharmacogenetic profile: maximum 4 weeks from the sending of the samples.
The delivery of results will be carried out by sending an email (and by post if the CLIENT so specifies) to the address indicated by the CLIENT to EUROESPES for this purpose.

ARTICLE 7 - GUARANTEES
All products on sale on the Website are covered by the legal guarantee in accordance with the applicable regulations and by the guarantee against hidden defects, which allows the Buyer to return defective or non-conforming products delivered to him free of charge.

ARTICLE 8 - SIGNATURE AND PROOF
EUROESPES works to protect the personal data of its customers by ensuring a high level of security; however, the Buyer must also participate in the protection of his personal data. In particular, the Buyer must maintain the security of his online transactions, for example by not communicating his identifier (e-mail address) or card number to anyone. In this regard, EUROESPES accepts no liability for the use of the Buyer's identifier (email address) and/or card number by a third party other than the Buyer.
EUROESPES accepts no liability whatsoever for the fraudulent use of this data. The communication of the bank card number and the final validation of the Order shall serve as proof of acceptance of the said Order and of the enforceability of the amounts committed for the reservation of the products appearing on the Order. The computer records, kept in the computer systems of EUROESPES and its partners, shall be considered proof of the communications, Orders and payments made between the Parties.

ARTICLE 9 - CUSTOMER SERVICE / MEDIATION SERVICE

ARTICLE 10 - LIABILITY
10.1 Capacity
We do not sell products to minors. The products we sell must be purchased by adults. Minors under the age of 18 may only use the EUROESPES Services under the supervision of a parent or guardian.
Prior to placing his Order, the Buyer declares that he has full legal capacity to be bound by these General Terms and Conditions of Sale. Consequently, in the event that a person who does not have legal capacity places an Order for goods on the EUROESPES Website, the persons legally responsible for this person (in particular, parents or guardians) shall assume full responsibility for this Order and, in particular, shall pay the price of the Order.
10.2 Limitation of liability
EUROESPES' liability for the obligations set out in these General Terms and Conditions of Sale shall not be engaged where the non-fulfilment of such obligations is attributable to the acts of third parties, even where such acts were foreseeable, to the fault of the Buyer or to the occurrence of a force majeure circumstance, as defined in the applicable jurisdiction, or to any other circumstances which are reasonably beyond the exclusive control of EUROESPES.
EUROESPES declines all liability for damages, direct or indirect, foreseeable or otherwise, suffered as a result of the Buyer's fraudulent use of the website.
In the event that EUROESPES's liability for damages suffered by the Buyer attributable exclusively to the placing of the order is established, such liability shall be limited to the amount of the order paid by the Buyer to EUROESPES.

ARTICLE 11 - PROTECTION OF PERSONAL DATA
In order to process the Order, EUROESPES shall collect the Buyer's personal data. The Buyer is hereby informed that EUROESPES, S.A. is the Data Controller and that the Buyer's data will be processed in accordance with the provisions of the Organic Law. and that their data will be processed in accordance with the provisions of Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights and Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data, whereby we hereby inform you that your data will be processed for the main purpose of maintaining and managing the contractual relationship with the Buyer. We also inform you that you have the right to access, rectify and delete your data, as well as other detailed rights as detailed in the Privacy Policy.

ARTICLE 12 - MISCELLANEOUS
12.1 Partial invalidity
If one or more provisions of these GCS are held invalid or declared invalid by application of any law, regulation or as a consequence of a final decision of a competent authority, the remaining provisions shall remain in full force and effect.
12.2 Exclusion of waiver
The failure of either Party to exercise its rights in the event of a breach by the other Party of any of its obligations under these GCS shall not be construed as a waiver of any future breach of the obligation in question.
12.3 Applicable law and competent jurisdiction
These General Conditions are governed by the laws of the Spanish State. The parties submit, at their choice, to the courts and tribunals of A Coruña for the resolution of conflicts and renounce any other jurisdiction.
Consumers who reside in the European Union and have had a problem with their online purchases on the Website, may use the European Union System for the extrajudicial resolution of online disputes by accessing the website:

12.4 Validity
The GCS shall apply for the entire period during which the products offered by EUROESPES remain online and until the expiry of the warranty periods.
